We perform a Name Availability Check at no additional charge as part of our services when you form your corporation or LLC with us.
If you're interested in determining whether or not your desired name is available right now (before forming your business) we offer this service, too. Many times our customers simply want to know about the availability of their name before proceeding.
Conducting a name availability check can ensure that your corporate or business name is available, and is not being used by a third party.
To make sure that your choice is available in your selected state, MyCorporation will conduct a preliminary, non-binding, Name Availability Check with each incorporation or LLC formation request before submitting your documents to the state office.
It is important to note that the name you request is not final until your state officials approve. Never rely on a corporate name check until after you have received a copy of your Articles of Incorporation, stamped with the state's approval.
The Process
- Fill out and submit the Name Availability Check order form on our website.
- You will find requests for standard contact, billing, and authorization information, plus specific information requests concerning your copyright.
- MyCorporation will contact the Secretary of State, as necessary, to ensure availability of your business name.
- MyCorporation will notify you of the availability of your business name.

Is a name availability check required before forming a corporation or LLC?
A name availability check is NOT required before forming your corporation or Limited Liability Company (L.L.C.). However, it may be wise to reserve a corporate or L.L.C. name if you are not yet ready to form the entity at this time or have some reason for delaying its formation.
What is my name is not available?
Sometimes your business name may be previously in use by a third party. In such instances, you may consider selecting a new corporate name that does not conflict with another business name in the jurisdiction in which you are incorporating.
What if I want to change the name of my company?
The only way to change the legal name of a state-level entity such as a corporation or LLC is to file an amendment to the Articles of Incorporation/Organization.
